By signing below, the participant, and any parent or guardian signing for a minor participant, knowingly and voluntarily requests permission to participate in the BLKLST Pickleball Doubles Tournament at Manhattan Park on July 26, 2026, and acknowledges that pickleball, tournament play, warmups, attendance, travel, food and beverage consumption, and related activities involve inherent and foreseeable risks. These risks include, without limitation, slips, trips, falls, collisions with players, spectators, nets, fences, posts, pavement, equipment, paddles, balls, bags, vehicles, or other objects; sprains, strains, fractures, concussions, heat illness, dehydration, cardiac events, illness, allergic reactions, property loss, and serious or permanent injury, paralysis, or death.
Each signer agrees that participation is entirely voluntary and at the participant's own risk. Each signer represents that the participant is physically and medically able to participate, will use appropriate equipment and footwear, will inspect playing conditions, will stop participating if unsafe or unwell, and will follow all posted and verbal instructions. Each signer assumes full responsibility for all risks, known and unknown, whether caused by ordinary negligence, weather, court conditions, equipment conditions, other participants, spectators, volunteers, sponsors, vendors, food or beverage providers, infectious disease exposure, or any other event-related condition, except to the extent a release is prohibited by applicable law. The signer acknowledges that possible exposure to and illness from infectious diseases, including but not limited to MRSA, influenza, and COVID-19, may occur, and that while rules and personal discipline may reduce risk, the risk of injury, serious illness, and death does exist.
To the fullest extent allowed by law, each signer releases, waives, discharges, covenants not to sue, defends, indemnifies, and holds harmless Next Dimension Fun LLC, BLKLST, BLKLST Pickleball Bags, the City of East Grand Rapids, East Grand Rapids Public Schools (EGRPS), event organizers, sponsors, volunteers, contractors, vendors, affiliates, property owners, venue operators, municipalities, and each of their respective officers, members, board members, officials, employees, agents, representatives, successors, and assigns from any and all liability, rights, claims, demands, actions, causes of action, judgments, losses, damages, legal proceedings, costs, expenses, medical expenses, attorneys' fees, and other obligations for any and all injuries, illness, death, or damage to person or property arising out of or related to participation in, attendance at, preparation for, travel to or from, photography or recording at, communications about, cancellation, postponement, modification, or operation of the event, or use of City or EGRPS facilities.
Each signer further agrees to indemnify, defend, and hold harmless Next Dimension Fun LLC, BLKLST, BLKLST Pickleball Bags, the City of East Grand Rapids, EGRPS, and their officers, agents, employees, representatives, successors, and assigns from and against any and all claims, judgments, losses, damages, demands, legal proceedings, costs, expenses, and attorneys' fees arising out of or resulting from the participant's use of City or EGRPS facilities, participation in the event, conduct, guests, invitees, equipment, submitted information, or breach of this agreement.
Indemnity and reimbursement for released claims. If the participant, a parent or guardian, an heir, estate, family member, guest, invitee, representative, successor, assign, insurer, or anyone claiming by or through the participant brings, continues, or assists with any claim that is released, waived, or covered by this agreement, each signer agrees, to the fullest extent allowed by law, to defend, indemnify, hold harmless, and reimburse the released parties for all resulting claims, judgments, losses, damages, settlements, legal proceedings, costs, expenses, and reasonable attorneys' fees, except to the extent finally determined to result from a released party's gross negligence, willful misconduct, or conduct that cannot be released or indemnified under applicable law. A parent or guardian signing for a minor signs both individually and, to the fullest extent allowed by law, on behalf of the minor participant.
Each signer grants BLKLST and Next Dimension Fun LLC permission to photograph, film, record, publish, display, edit, and use the participant's name, team name, likeness, voice, image, submitted team photo, and team description for event administration, website display, social media, advertising, and promotional purposes without additional compensation. The organizer may refuse, suspend, remove, disqualify, or modify participation for unsafe conduct, rule violations, intoxication, abusive behavior, weather, court conditions, schedule constraints, capacity, payment issues, or any other event-management reason. Prizes, giveaways, food, drinks, format, schedule, scoring, match length, and bracket structure may be adjusted at the organizer's discretion.
For participant-requested cancellations approved by BLKLST, the standard refund is $14 per $15 player entry, with $1 retained as a nonrefundable processing and administration fee. Refunds may be denied after brackets are seeded, after event-day check-in, or where a participant is removed for unsafe conduct, rule violations, abusive behavior, intoxication, no-show, or other event-management reasons. If BLKLST cancels the tournament outright and does not reschedule or provide a substitute event opportunity, BLKLST may issue full refunds at the organizer's discretion.
Each signer understands that information submitted to the City of East Grand Rapids is considered public information and may be subject to disclosure under the Freedom of Information Act. The signer also understands that event records, waiver records, payment records, and safety-related records may be retained or disclosed when reasonably necessary for event administration, legal compliance, insurance, safety, fraud prevention, dispute handling, or cooperation with venue, municipal, school, payment, or legal authorities.
Each signer understands that this electronic signature is intended to have the same legal effect as a handwritten signature and confirms that they have read, understood, and agree to this waiver, release, indemnification, media release, and participant agreement.
